Message of Felicitation of the Esteemed Amir-ul-Momineen, Sheikhul Hadith Hibatullah Akhundzada on the Eve of Eid-ul-Adha

In the name of Allah, the Most Merciful, the Most Compassionate

Allah is the Greatest; Allah is the Greatest; Allah is the Greatest. There is no god but Allah. Allah is the Greatest, Allah is the Greatest.  All praise be to Allah.

 Praise be to Allah Who favored us with the blessing of faith and Islam as He sent down on us the best of His books and sent us the best of His prophets and legislated for us the best of His religious law. All praises be to Allah. All the good is in His Hand and all affairs return to Him. He creates whatsoever He wills and chooses. We have not the choice. All the glory is to Allah as well as all the praises in this world and the world to come. His is the decision and you all return to Him.

I testify that there is no god but Allah. Alone is He and has no associate. I testify that Mohammed (pbuh) is His Servant and Messenger. He conveyed the Message and fulfilled the obligation and preached the Ummah and fought in the cause of Allah as it is due. May peace and blessing be on him and His descendents, the good and the pure ones and on his companions and followers and all those who duly followed him until the doomsday. After this, I would like to say:

Allah, the Almighty says:

“Therefore pray to your Lord and sacrifice (to Him)”. (Chapter:108, Verse:2)

(My) Believing countrymen and brothers and sisters-in-faith in every corner of the world.

Asalamu Alaikum wa Rahmatullah wa Barakatuh,

While wishing you (good) health, happiness and prosperity, I would like to extend you my felicitation on the occasion of the auspicious Eid-ul-Adha. May Allah (SwT) accept in His Sight all your worships, sacrificial offerings, charities and all deeds that you have done for the pleasure of Allah (SwT). In addition to the felicitation of the auspicious Eid-ul- Adha, I would like to congratulate the Mujahid people, particularly, the Mujahideen of the Way of Truth on the recent victories which the Almighty Allah has bestowed on the formations of Jihad because of His special blessing and the help and the sacrifices of the Mujahideen and the help of the people, notwithstanding the use of heavy force by the enemy; the influx of foreign troops and the bombardment of different bombers. Still many districts and areas have been cleared from the enemy in different provinces of the country. Praise be to Allah, the white flag of the Islamic Emirate is fluttering there.

(My) Mujahid Brothers,

At the first years of the occupation, our obligation was to combat against the enemy but now as we have control over many areas of the country, it is the time that we should reap the fruit of the 15 years-long jihad and implement objectives of jihad which are: implementation of the Divine Sharia on the land of Allah; to establish justice; maintain stability and security; to protect frontiers and defend life, property, honor and all other God-given rights of the countrymen.

The officials of the Military Commission, governors, the  personnel of the judicial courts, members of the provincial commissions, the district administrators and commanders of (armed) units and all personnel of civilian commissions should pay exclusive attention to the maintenance of security and justice, implementation of Sharia, efficient governance, promotion of religious and modern education and other works of public utility like roads, bridges, health affairs, drinking water, agriculture and trade and other public works. Stop those who harm these places of public utility so that (our) believing people may lead a bright, happy, sufficient and prosperous life under the shadow of the sovereignty of Sharia and take a breath of relief in an atmosphere of peace.

For Mujahideen in order to succeed in this big trial, they should specifically pay attention to these points:

–Make your intention purely for Allah and for the cause of Allah (SwT);

–All should adorn themselves with the ornaments of piety, both the juniors and the seniors;

–keep on praising Allah (SwT) that He enabled you to perform the sacred obligation of Jihad;

–Do justice and do favor;

–Desist from pride, vanity conceit, wrong-doing and treason and keep away from any bias based on ethnicity, geography, language and clique;

–The criterion for privilege should be only piety and commitment;

–Create an atmosphere of confidence and brotherhood among yourselves and avoid acts leading to distrust among you;

–The Mujahid brothers should not abandon the obligation of promotion of virtue and prevention of vice. Conduct your prayers in congregation and desist from committing treason in Baitulmal (public treasury);

–Assume sponsorship of the families and children of martyrs and prisoners in the best manners that can be;

–Never forget the Sharia-based way of conduct of your demised, beloved and kind leaders, Amir-ul-momineen Mullah Mohammed Omar Mujahid (may Allah bless him) and Martyr Amir-ul-monineen Mullah Akhtar Mohammed Mansoor (may Allah bless him) and meticulously adhere to their ways. Deem  it as (your) religious service and a high goal to serve people and provide prosperity and comfort to them because removing trouble of people is the most beloved act in the sight of the Holy Prophet of Allah (peace be upon him).

Ibn Umar (may Allah be pleased with him) reported: the Prophet, peace and blessings be upon him, said, “The most beloved people to Allah are those who are most beneficial to the people. The most beloved deed to Allah is to make a Muslim happy or to remove one of his troubles, or to forgive his debt, or to feed his hunger. That I walk with a brother regarding a need is more beloved to me than that I seclude myself in this mosque in Medina for a month”. (al-Tabarani)

The Mujahid brothers should exclusively focus on purging their ranks and files. Do not let unscrupulous, notorious, self-indulgent, and money-grubbing and immoral persons remain in your ranks — those who misbehave with people. This is in order the people may not face harassment. Mujahideen should maintain interaction with honorable religious and spiritual leaders, tribal influential and pious men of insight; seek their views and advice and benefit from their experiences. In addition to military training, train Mujahideen how to behave well with people, prevent civilian casualties, maintain justice and win hearts and minds of people; instruct them from time to time about people’s rights and dignity. Mujahideen should behave well with those who leave the (ranks of the) corrupt Kabul Administration or are detained.

I instruct Mujahideen brothers to perform the duty of Call and Guidance, focus on alluring those who are in the ranks of the enemy, in addition to carrying out (your) Jihadic operations. For this purpose, the Mujahideen, the personnel of the Call and Guidance Commission, the personnel of the Cultural and Media Affairs, men of letters and learning should fully pay attention to (the work of) awareness and allurement; and besides the training of Mujahideen and the emerging generation, disseminate messages for those who are in the ranks of the enemy so that they understand the veracity and success of the ranks of jihad and become aware of their Islamic and valorous history and know the ills of subjugation and perceive that further remaining in the ranks of the invaders is but a harmful and destructive act.

We are grateful to all those beneficent people in every corner of the world who have helped the Islamic Emirate or trust this Jihadic formation, all those honorable religious scholars and writers who have affirmed and supported our cause or shared with us their best views or showed their sympathy with us or expressed their condolence during the demise of Amir-ul-momineen Mullah Mohammed Omer Mujahid (may Allah bless him) and Amir-ul-momineen Mullah Akhtar Muhammad Mansoor (may Allah bless him). I ask the Almighty Allah to fully reward them for their honesty.

Availing myself of this opportunity of the auspicious occasion of Eid-ul-Adha, I call on all Afghans who work in the military and civilian sectors of the foreign invaders to ponder over their stance for a moment and figure out for themselves that the invasion of Afghanistan by America and her Allies is part and parcel of the global war of non-believers against the Islamic Ummah. Its aim is to dismantle real Islamic systems and help its trained surrogates reach the corridors of power; to spread anti-Islamic laws, thoughts, and dogmas and customs in this Islamic land. Therefore, they should ponder deeply over their jeopardizing position of their being in the ranks of the invaders. Their support to the invading non-believers is undoubtedly in contradiction with the command of the Almighty Allah and His prophet (peace be upon him). The Almighty Allah says:

“Let those who disobey His orders, beware, lest some grief or painful punishment befall them”.(Chapter: 24, Verse:63)

Our message to Islamic countries and all freedom-loving people of the world is that our struggle is not an illegitimate struggle, nor it is a rebellion for unlawful objectives nor a mere expression of emotions without any pillar of Islamic ruling. Contrarily, our country has been invaded and an anti-Islamic, subservient and surrogate regime has been imposed on us by dent of tanks, artilleries and bomber aircrafts against the wishes of our religion and independence-loving and independent thought-loving people. An Islamic system and independence of our country is our human and religious right. The Islamic countries and the freedom-loving people of the world should support our just cause as per their obligation and perform their due responsibility by supporting our oppressed people.

The Islamic Emirate of Afghanistan has been continuing to make diplomatic efforts aimed at resolving the issue of Afghanistan alongside its military approach. We have nominated the Political Office for this purpose as well as for maintenance of relations with the world and pertinent entities (for peaceful and diplomatic efforts). We want to have relations with the world and answer their questions and mitigate their concerns so that we will save our country from further harm in the future and that others will also not be harmed from our country.

We condemn in strongest terms all sorts of atrocities being committed against Muslims in many parts of the world, particularly, in Syria where Muslims are being strafed under one name and another. People’s houses, mosques, educational and health centers have been razed to ground. We call on the people in every corner of the world who have a free conscious to raise their voice for prevention of these atrocities. All these injustices and atrocities which are being perpetrated against the oppressed people with impunity, if they are not stopped, then everyone will be harmed — because on the one hand, the tyrants are continuing their atrocities and use of force and on the other hand, the oppressed victims resort to every mean for deliverance from their miserable condition and for taking vengeance. As a result, the security of the world can deteriorate.

To end we urge all wealthy and beneficent brothers and sisters to share in your festivities the families of the martyrs, prisoners, the handicapped, orphans and the families of the Mujahideen of the stronghold of Truth and their children in these auspicious days of Eid-Adha and help them as you may afford. I leave you to the trust of Allah

US ex-drone operators join Yemeni drone victim in court challenge (Reprieve statement)

Three American ex-drone operators have filed a legal brief in support of an innocent Yemeni drone victim’s lawsuit in Washington DC.

Brandon Bryant, Lisa Ling and Cian Westmoreland, who have all worked on the Obama Administration’s drone killing program, weighed in to support Faisal bin ali Jaber, a Yemeni environmental engineer whose innocent family members were killed in a US strike.

Their submission in Jaber v Obama challenges the idea that the American public can serve as the sole check on executive power in cases like Mr Jaber’s: “From their collective experience working on the drone program or on drone systems, amici believe the public has been misinformed about the effectiveness of drone strikes and the way they are conducted. There can be no electoral accountability if the public is misinformed”. They go on to stress the central role the US courts must play in such cases.

Mr Jaber is seeking an official apology and declaration of error – not money – for his relatives’ deaths. His brother-in-law Salem and his nephew Waleed died in an August 2012 strike in their village. Salem was an anti-al Qaeda imam who is survived by a widow and seven young children; Waleed was a 26 year-old police officer with a wife and infant child. Salem had given a sermon preaching against extremism just days before he and Waleed were killed.

In his appeal filed last month, Mr Jaber challenged the district court’s acceptance that American judges cannot review even the most heinous war crimes by the Executive branch.  An international law professor, Mary Ellen O’Connell, also filed a supportive brief, writing: “The failure to scrutinize the claim would amount to a failure of the courts to hold the executive to the very law the Government acknowledges it must obey.”

The case is President Obama’s first chance to make good on his recent Executive Order on American drone killing, where he promised to “acknowledge US government responsibility for civilian casualties.” To date, his Administration has fought hard in court to avoid such an acknowledgement in Mr Jaber’s case.

Leaked intelligence indicates that U.S. officials knew they had killed civilians shortly after the strike on Mr Jaber’s family. In July 2014, the family was offered a plastic bag containing $100,000 in sequentially-marked US dollar bills at a meeting with the Yemeni National Security Bureau (NSB). The NSB official who had requested the meeting told a family representative that the money came from the US and that he had been asked to pass it along.

In November 2013, Faisal had traveled to Washington D.C. and discussed the strike with Senators and White House officials. Many offered personal regrets, but the US government has refused to publicly acknowledge or apologize for the attack.

In April 2015, President Obama publicly apologized for the drone killing of an American and an Italian citizen held in Pakistan – Warren Weinstein and Giovanni Lo Porto – and announced an independent inquiry into their killings. Faisal’s family has not yet had an acknowledgement of Salem and Waleed’s deaths.

Faisal is jointly represented by the international human rights organization Reprieve and pro bono counsel at the law firm Lewis Baach pllc. The three ex-drone operators are represented by attorneys at the Whistleblower & Source Protection Program (WHISPeR).

Faisal bin Ali Jaber said: “Since the awful day when I lost two of my loved ones, my family and I have been asking the U.S. government to admit their error and say sorry. Our pleas have been ignored. No one will say publicly that an American drone killed Salem and Waleed, even though we all know it. This is unjust. If the US was willing to pay off my family in secret cash, why can’t they simply make a public acknowledgement that my relatives were wrongly killed? These things matter.”

Shelby Sullivan, Reprieve US attorney for Mr Jaber, said: “Faisal’s case demonstrates the folly of the US drone killing program. Not only was Faisal’s family innocent, they were the very people we should be supporting. His brother-in law was a brave imam who preached against extremism; his nephew was a local police officer trying to keep the peace. Unlike Western victims of drone strikes, Faisal has not received an apology. He simply wants the US Government to tell the truth and say sorry – it is a scandal that he has been forced to turn to the courts for this most basic expression of human decency.”

Eric Lewis, partner at Lewis Baach pllc, the law firm that is representing Mr Jaber’s family pro bono, said: “President Obama has rightly said that the United States must face up to its mistakes in the drone killing program: here is an opportunity. The drone strike that killed Faisal’s family was taken in violation of both US and international law. There was no ‘imminent threat’ to the US, and there was a clear probability of needless civilian deaths. It is time for innocent drone victims to be treated with dignity by our government. This includes telling bereaved families the truth about how and why their loved ones died.”

Remarks by spokesman of Afghanistan: Islamic Emirate regarding unjust condemnation and verdict by Amnesty International

The other night, several martyrdom seekers of Islamic Emirate targeted an important secret intelligence center of Kabul administration and foreign invaders in Shahr-e-Naw area of Kabul city inflicting heavy losses on the enemy.

Following the attack, Amnesty International labelled this attack a war crime and published a statement suiting the fancy of the US embassy.

We strongly condemn the unjust verdict and misuse of the impartial status of Amnesty International by its Asia Branch.

Out attack was against a military-intelligence center handled by the former head of intelligence of the Kabul administration and containing a branch of Intel sharing by foreign invaders.

That there was a NGO – CARE International – located on a street across this military zone then this has nothing to do with the plan of operation. The target of this operation was not CARE International and this has also been affirmed by CARE International in its statement describing the target as a compound close to their office.

It is astonishing that CARE International does not consider this attack as an attack on its office however the Asia Branch of Amnesty International is forcing it upon them.

We have always declared at launch of our spring operations that civilians and civilian compounds must keep their distance from the military and intelligence centers of foreign invaders and their stooges so that they are not harmed during attacks. Therefore it is not our responsibility that such NGOs brush aside our warnings.

This is not the first time Amnesty International has unjustly ruled against us rather they also accused us of wrongdoings during the conquest of Kunduz last year in accordance with the guidelines of invaders and intelligence circles.

Yesterday the Asia Branch of this supposed impartial third party organization (Amnesty International) also advised the American intelligence (CIA) to make use of new technology in preventing further Mujahideen attacks, and thus prevent the attacks of independence seeking Afghans.

Such remarks and unfounded reports by Amnesty International show that this society is not a Human Right organization but is greatly influenced by the intelligence agencies of western invading countries. That is why it carries out suspicious activities to attain malicious goals which will further bring her impartial status under the spotlight and raise doubts in the minds of common people.

Statement of Islamic Emirate regarding traffic accident on Kandahar-Kabul highway

It is with great sadness to have learnt that a traffic accident has once again taken place on the main Kandahar-Kabul highway in Zabul province peripheries, resulting in the death of 36 countrymen and injuries to 21 others.

The Islamic Emirate is greatly distressed by this incident and shares in the grief of those affected by this tragedy.

The Islamic Emirate will launch a serious investigation into the shocking incident, hold accountable the negligent party and will exert full efforts to prevent such incidents from transpiring in the future.

We ask Allah Almighty to grant Jannah (Paradise) to those martyred in this accident and swift recovery for the injured. And we pray that their families and relatives are blessed with patience and immense rewards.

Remarks by spokesman of Islamic Emirate concerning military aid to the Kabul administration by the Indian government

Historically the people of Afghanistan have not proved detrimental to nor interfered in the internal affairs of others and they seek a reciprocal treatment towards the Afghans from other countries.

The Islamic Emirate of Afghanistan – as a representative of its people – is waging a war against the American occupation. Those waging war against us are either foreign invading countries – who toppled our established government, are killing our people, destroying our homes and have snatched freedom from our nation – or the warlords and incompetent and corrupt individuals of the Kabul administration who have been forced upon our people by America. They do not have the popular support and backing of our people and only work for their own interests by spending their short political lives under the wings of American aircraft.

Reports circulating in the media state that India will be providing military aid to the Kabul administration in form of aircrafts and other equipment. This is the severalth time that India is giving the stooge Kabul administration military aid and it is an obvious fact that such weapons will be used to kill our people, oppress our nation and destroy our homes and public welfare structures, a good example of which is Puli Alchin bridge in Kunduz recently destroyed by regime helicopters that were provided by the Indian government.

Providing the Kabul administration with such deadly weapons cannot be interpreted as friendship with the people of our country but as support for a criminal foreign backed group and clear hostility towards our people. The Islamic Emirate condemns this action with the strongest of terms. Such acts will create distrust between the people of both countries and become a reason for further deterioration of relationship.

We call on India to stop exporting items of killing and destruction to Afghanistan and to stop efforts of prolonging the lifespan of this corrupt regime with its military aid.

If anyone wishes to strengthen the Kabul stooge administration with military aid during occupation, this cannot be interpreted as anything other than enmity with the Afghans and shall arouse hatred of the people of Afghanistan.

Abdul Hamid Faruki writes on Muslims seeking knowledge

“The seeking of knowledge is obligatory for every Muslim.” – Al-Tirmidhi, Hadith 74

A reminder firstly to myself before others,

We had a period in our religion when our scholars, or respected personalities of Islam used to travel far and wide for knowledge. They used to travel thousands of miles in extreme heat or cold, day and night and whilst living under tyranny or being persecuted for their beliefs. It was the thirst for knowledge that made these people leave their homes and families and travel the globe. It was also to verify the authenticity of what they wanted to learn before they educated their communities. The modern world is no different. Scholars travel to all corners of the world to seek knowledge from the most respected teachers and schools this religion has to offer. They sacrifice years away from home to better themselves and their people.

On the other hand, you have people like me and you, the ‘average’ Muslim, living in the West or the East. We surf the web to get information regarding Islam, we debate on social media and spread what we have learned to others. There is no verification of the information or the source, we don’t even ask for guidance. Scholars used to travel for days just to acquire one hadith. They wanted to hear it with their own ears, so they could verify its legitimacy. At the rising of the sun, we are ordinary working class Muslims, by dusk, we have become experts in Islamic Jurisprudence. We think we can substitute minutes of acquiring knowledge, for years of sacrifice by our scholars. No doubt as time has evolved it has become easier to obtain what we need. However, sometimes it has become the most easiest and abused way for us. Mosques, libraries, institutes and ulema are at our disposal, use them wisely. We are not living in places like China, Gaza or Athens where Muslims are being persecuted for practising Islam. As Muslims living in developed countries, we have no excuses for being ignorant and uneducated.

It’s becoming an increasing trend between some of us where we publicly criticise and refute others. The new fashionable way of doing it is on social media – keyboard warriors and YouTube heroes. We condemn a person or a scholar based on certain actions, or their interpretation of Islam, without even questioning why such a thing is being done or the reasons behind it. We will tear them apart without fearing Allah, and then if we find out we’re in the wrong, it becomes hard for us to apologies. The art of civil debating and meeting a person face to face to dialogue has been lost. Scholars are here to guide us, they are humans just like us, and mistakes are committed by everyone. It may not be their intention to preach falsely, they may be unaware of certain actions they commit, it’s our duty to rectify them within the parameters of Islamic law. Indeed some are amongst us to cause division, hatred and are adhering to outside agendas. We expose those that we shouldn’t, and hideaway those that need exposing.

There will always be a difference of opinions when it comes to Islamic theology and Jurisprudence, for example; the schools of thought. As long as it’s minor, we shouldn’t allow it to cause tension amongst ourselves. The companions of the prophet differed in opinions, Umar ibn Al-Khattab (RA) and Abu Bakr Al-Siddiq (RA) differed on opinions, but it was for the love of the prophet Muhammad (PBUH) and for the sake of Allah. They didn’t detest each other and create sectarian hatred, they were still brothers in sisters in Islam. As an Ummah they were united, as an Ummah they protected the dignity of our sisters, they liberated lands that were under oppression, they fought against tyranny, they protected communities and they instilled a noble way of life.

It’s disturbing to see how we have drifted away from everything that was handed to us, from that which the Ummah has shed blood, sweat and tears for. Today conferences and gatherings are held where Muslims refute and discriminate other Muslims. Without any reasoning we will criticise the shuyukh. We want to be the next Salahudeen or Khalid bin Waleed, yet we can’t speak out on things that matter to us. We admire the likes of Bilal (RA) but we look at colour, caste and nationality before we marry. We want to liberate Palestine and help the Syrians, yet we argue with our parents and break family relationships. Our sisters are being raped, our brothers imprisoned innocently, our children being made orphans, lands being stolen, and our leaders are selling their souls. While all this is happening we are busy arguing about where are hands should be in salat, if we should say ameen softly or quietly or whether it’s an innovation to say jummah mubarak. We will constantly discuss the same topics over and over again in the mosques and Islamic conferences. Surely all aspects of the religion should be attended to, but why the silence on issues that are challenging the Muslims today? Who are we scared of? Who are we trying to appease? There is nothing wrong with holding our roles in societies or status amongst people, but at what cost? At the cost of our brothers and sisters being killed and raped? At the cost of Al-Quds being taken over by Zionists on a daily basis? At the cost of injustice? We need to talk about the proper way of Jihad, we need to discuss the correct implementation of the Shari’ah, and we need to discuss the plight of Muslims worldwide. With the power we hold, we need to accept the responsibilities.

The Ummah is asleep, we are breaking apart. The Muslims once contributed so much to the world, from advancements in technology and sciences to mathematics. Almost a third of the world at one time was part of the Islamic Empire, now we don’t even have a proper Islamic country. We have become lazy, ignorant and arrogant and relish in our past. We don’t act until it affects us personally, then we cry to the heavens for help. It hurts when people and nations label us as “terrorists” and “extremists”, but we have no problem in labelling are own with derogatory titles. The Ummah is bleeding and being raped from all angles, however it doesn’t seem to bother us. We are content with our materialistic life and ‘freedom’ that we have. It is time we realised what is going on around us and we need to make a stance. Without unity, very little can be achieved.

The Prophet Muhammad (PBUH) on countless occasions made supplications for his Ummah, he shed tears for this Ummah. Where are our tears? Even whilst nearing his death, the prophet was attending to important matters. Things that we neglect and take for granted while we are living. He uttered words of advice and showed concerns for the Ummah. His final sermon was a speech for all mankind, past, present and future. People have come and gone, good or bad, they have left a legacy behind and made an impact on people. The question is, what will be our legacy, and what will be on our tongues in the final moments?

Islamic Emirate, Afghan Taliban have claimed responsibility for twin blasts near the Afghanistan Ministry of Defence in Kabul on Monday. The attack occurred as people were leaving work killing 24 people and wounding 91 according to Waheed Majroh, health ministry spokesman, reported by Dawn media.

President Ashraf  Ghani who had just released his “Remarks at the Special Meeting of the Joint Coordination and Monitoring Board on Brussels Conference for Afghanistan” claimed, “the enemies of Afghanistan have lost their ability to fight the Security and Defense Forces of the country.” This does not appear to reflect the reality on the ground where the Taliban have made significant gains during the past year including Helmand province and in the region of Kunduz.

The security situation looks likely to worsen following Kabul primary court issuing a death sentence for Anas Haqqani son of jihadi leader Mawlawi Jalaluddin Haqqani of the Haqqani network, Sunni Islamist militant organization fighting US-led NATO forces (viewed as invader/occupiers) and their allies, the government of Afghanistan. Islamic Emirate: The Political Trial of Anas Haqqani and the Reasons behind it

Last Monday Kabul primary court issued death sentence for Anas Haqqani. Nearly two years ago Anas Haqqani was arrested by American Intelligence agency in Bahrain and later he was handed over to The National Security Directorate.

Anas Haqqani was accompanied by his compatriot Hafiz Rashid he was traveling to Qatar to meet the prisoners who were released from Guantanamo Bay prison after an exchange deal for military officer Bowe Bergdahl. All the released prisoners are now under observation in Qatar.

Few days after the capture of Anas Haqqani by Americans and his hand over to Kabul, the National Directorate of security announced that they have captured Anas Haqqani and Hafiz Rashid in an operation in Khost province of Afghanistan.

Taliban denied the false news and a formal declaration was issued in which the full details of the arrest of Anas Haqqani and his detention by Americans in Bahrain was disclosed.

The violations of commitments by the Americans with Qatar

On June 18, 2013 by the mediation of Qatar Government, a first ever formal prisoner exchange took place between the Taliban and American government.

In this exchange the American military officer Bowe Bergdahl was exchanged and 5 Taliban prisoners were freed from Guantanamo Bay Prison. Bowe Bergdahl was arrested by Taliban in Paktika province in 2009 after he left his military base.

In the agreement between the two parties by the mediation of Qatar, it was agreed with the Qatari Government that the 5 released prisoners will be under the supervision of Qatari officials for a year and their relatives will be able to visit the prisoners with full freedom.

On the basis of the agreement and in accordance with the article titled (ideal conditions, limitations and confidence) in the agreement between The US and Qatari government in the 10th clause it is written that:
The Qatari government can give permission to the family members of the exchanged prisoners to live in Qatar. The released prisoners will first consult and inform the Qatari government about their every family member coming to visit them and after that the Qatar government will give them legal residence documents.
In accordance with this agreement the family members of the released prisoners will be able to visit them and also they will have the right to live with them in Qatar.
In the practical application of the above stated points of the agreement US and Qatari government are both equally responsible.

Anas Haqqani and Hafiz Rashid are the relatives of Muhammad Nabi Omari, one of the 5 released prisoners. They went to meet the released prisoner who is their family member with the approval of Qatari government and in accordance with the prisoners exchange agreement. They were arrested after they were coming back from Qatar from their meeting with Muhammad Nabi Omari. Americans arrested them breaking the formally signed agreement between America and Qatari government.

Anas Haqqani is the son of famous jihadi leader Mawlawi Jalaluddin Haqqani and an ordinary student of religious school. He is also one of those members of his family who is not sanctioned by any authority because he was not involved in any political or military activity.  There was no prize money on his head as he was not involved in any military or other activity.

The only reason behind his arrest by the Americans is that he is the son of Mawlawi Jalaluddin Haqqani and the brother of Sirajuddin Haqqani.
In judicial terms and rules only one’s personal actions are presented for trial or prosecution and the actions of his relatives and family members etc are not accountable for penalties of the person who is under a trial or who is to be prosecuted.

The judicial review of Anas Haqqani’s trial:

Looking at the personal situation of Anas Haqqani, he is not accountable for anything according to the judicial system and law. According to law and rules he should be freed. The main reason is that the American government and the Afghan government both do not have any proof or material etc to keep him in detention.
If the detention of a person is against the law and norms of judicial system how can he be sentenced to death?
In the light of the above arguments and points discussed, the death penalty of Anas Haqqani is politically imposed. There are no legal grounds on which the death sentence could ever be awarded to Anas Haqqani.

This death sentence is against the Afghan judicial system and norms followed since the beginning. There is no justification in judiciary for this sentence of Anas Haqqani.

For the death sentence to be awarded to a person both in the International and Afghan judicial system the personal actions of the person to be tried are accounted. The person under trial is free from the actions of his father, brothers, family members and all other relatives and friends etc.

We can rightly and truly say that the death sentence is imposed politically on Anas Haqqani either by the pressure of the American government or other political motivations. It is visible as the trial was also kept in secret because it is not on the basis of the applicable laws and judicial system norms.

If the World Humans Right Commission and the Afghanistan Independent Human Rights Commission are genuinely human rights defenders they should ask the American government and officials about the legality of the detention of Anas Haqqani and his arrest which is also against the agreement formally signed by the American and Qatari governments.

Illegitimate government and its politically partial orders

As we know the current establishment and setup of Afghan government is against the constitution of the country which was earlier created by the Americans themselves. This current government was created and formed against the concept of democracy itself, a concept which many in the west boast about. On the basis of the said and mentioned reasons many rules and regulations now made and many judgments which are passed are also against their own laws which were paved by for them.

As the system and the whole setup of the government functions on America’s will, it is clear that many things are imposed by the will and acceptance of Americans. Every judgment is passed with the desire of American establishment and their approval.

The same judicial system and its members gave death sentences to 6 political prisoners on illegal grounds and against the judicial law and they were later hanged in the current year 2016.  When this move was criticized by human rights protection organization and legal experts the presidential palace issued a formal statement in defense of judicial authorities and said that by the frequent emphasis of the relatives and families of the victims the sentenced who were terrorists were hanged.

But the son of Ustad Burhanuddin Rabbani, the foreign minister Salahuddin Rabbani while rejecting the statement of President Ashraf Ghani posted on his social media ( Facebook ) account that the accused person who was hanged – on the charges of the murder of his father – was hanged without the consultation of him his family and The Jamiat-e-Islami political party. He also mentioned in his post that he was also not in full agreement for the death sentence which was awarded to the accused.

Conclusion

Islamic Emirate: The Flight of the Afghan Youth from the Country, an Anathema

In 2001, when America invaded Afghanistan, their domestic supporters were very happy assuring the Afghan people regarding initiation of big projects in agricultural, industrial and other economical sectors and promising a prosperous and comfortable life. But now after one and half decade, 200,000 afghan have fled to European countries according to international surveys conducted in 2015 because of unemployment and poverty. This constitutes 20 percent of all immigrants gone to Europe. Unfortunately, in most cases they face discrimination. Moreover three million Afghans are addicted to drugs. The main reasons are economical and social problems and the spread of foreign culture. Furthermore, forty percent of the people of Afghanistan are living under the poverty line and economical growth of the country is less than two percent. This is the economical and social situation of Afghanistan in the epoch of invasion and democracy.

These problems have emanated from the corruption which has reached its peak level in the rungs of the Kabul Administration. Similarly, because of incompetency, the institutions and ministries of Kabul regime is merely spending 30 to 40 percent of the allotted budget while other budget amount remains unspent. But these expenses are also ghost figures because of corruption. The amounts are shown as having been spent on the face of government documents but in reality, it goes to the pockets of warlords and high profile officials.

No big dam has been constructed in the country during past one and half decade. In industrial sector, the existing factories have stopped functioning. Two thousand national businessmen have returned their business licenses to Kabul Administration during the past few weeks because of mafia abductions and other problems.

The invaders are speaking of having spent more than 35 billion dollars during past fifteen years but practically there is no tangible sign rather a great amount of these expenses have gone to the pockets of foreign and domestic contractors.

International surveys show that besides ghost soldiers and schools, there are tens of ghost health clinics as well. Their salaries are paid and medication delivered but in reality there is no school and clinic. Consequently, now tens of thousands children in Afghanistan lose their lives from preventable diseases like diarrhea and pneumonia while other one millions are malnutrition. Still, leaders of Kabul Administration are speaking about achievements in Afghanistan but they are neglecting the fact that they have always held third, second, or first position in corruption and injustice according to annual reports of Transparency International index and International Justice Organization. These surveys are not published by anti-western organizations rather conducted by NGOs formed by the West and run under their management.

The Islamic Emirate believes that flight of the youth from the country as a result of the anomalies of the incompetent and surrogate administration is an anathema in addition to other problems. It would have negative impacts on the future of the country and it also proves that prosperity and progress of the countrymen could not be achieved under the shadow of occupation. Therefore, Islamic Emirate is struggling for a genuine independence and Islamic system in the country, so that, all Afghan will remain in their homeland and will not be compelled to go to foreign countries. Their abilities will be utilized in the development, prosperity and well-being of their own country and they will lead a prosperous, creative and honorable life in their own country.

Islamic Emirate: War crimes of foreign invaders and their internal mercenary forces (August 2016)

On Monday 1st August, a teacher named ‘Mohammad Shafiq’ was relentlessly martyred by the internal stooge soldiers in the central city of ‘Maidan Wardak’ province. He had recently migrated from ‘Narkh’ district of this province to the center of this province.

On Tuesday 2nd August, ordinary civilian houses in ‘Joibaar’ area of ‘Tagab’ district in ‘Kapisa’ province came under indiscriminate mortar shelling of amateurish local soldiers, in which, two women were wounded.

On Wednesday 3rd August, two civilian countrymen were martyred in the random mortar shelling of internal mercenary soldiers in ‘Lawaara’ area of ‘Chamkani’ district in ‘Paktia’ province.

On Thursday 4th August, in ‘Nawa’ area of ‘Mizana’ district in ‘Zabul’ province, civilian houses became the target of mortar shelling, indiscriminately fired by the stooge local in-security forces, in which, one child was martyred in a house while two more children were injured.

On Friday 5th August, two children were martyred and two women were injured in the random mortar shelling of internal stooge soldiers on civilian houses in ‘Nazarwal’ village of ‘Shilgar’ district in ‘Ghazni’ province.

On Sunday 7th August, civilian houses in ‘Jikhoji’ village, at the distance of three kilometers from a military check-post, became the target of mortar shelling, fired by local stooge soldiers, in which, three ordinary countrymen were martyred and six others were injured.

On Monday 8th August, ‘Ghori-Ada’, ‘Bozi’ and ‘Tani-Khail’ villages of ‘Sapaira’ district in ‘Khost’ province were raided by the local stooge soldiers. Meanwhile these soldiers were confronted by Taliban. After this confrontation, the wicked soldiers opened indiscriminate fire on local dwellers, in which, three innocent civilians were martyred and six others were seriously wounded. Moreover, a number of ordinary villagers were detained and then taken away as prisoners by these mercenary soldiers.

On Friday 12th August, thirteen ordinary people were martyred in the indiscriminate and savage bombing of brutal foreign invaders in ‘Minari’ village of ‘Khoshamand’ district in ‘Paktika’ province. The house of a local doctor, named Dr. Wrishmin, became the target of this bombing, in which, thirteen members of his family including him, were martyred. The local eye-witnesses told ‘The Afghan Islamic News Agency’ that all those who were martyred in this savage attack were civilian people, including women and children. It was also confirmed by the provincial officials that all the victims of this carnage were ordinary civilian people.

On Friday 12th August, a local villager, named ‘Masto Khan’, while working in his fields, was brutally killed by the local soldiers in ‘Ahmad Khail’ village of ‘Jalga’ district in ‘Maidan Wardak’ province.

On Saturday 13th August, civilian houses in ‘Daman-i-Koh’ village of ‘Zarghun Shar’ area in ‘Mohammad Agha’ district of ‘Logar’ province became of target of random mortar shelling of mercenary soldiers, in which, a child and a women were martyred in the house of an ordinary countryman, named ‘Said Jan’.

On Monday 15th August, six innocent civilians were injured in the indiscriminate shelling of local unrestrained Arbaki militiamen in brook no. 28 in ‘Ghani Khail’ district of ‘Nangarhar’ province.

On Monday 15th August, fifteen ordinary civilians, including women and children, were brutally martyred in the indiscriminate bombing of puppet regime jet fighters in the suburbs of ‘Dahana-Ghori’ district bazaar in ‘Baghlan’ province.

On Monday 15th August, the son of an ordinary villager ‘Mir Ahmad Aka’ was martyred while his nice was seriously wounded in the random mortar shelling of local amateurish soldiers in ‘Sultan Khail’ village of ‘Said Abad’ district in ‘Maidan Wardak’ province.

On Wednesday 17th August, seven civilian people were incarcerated during a raid of savage foreign invaders, collaborated by their internal mercenary forces, in ‘Hadya Khail’ area of ‘Chaprihar’ district in ‘Nangarhar’ province.

On Thursday 18th August, civilian houses in ‘Raes Abduallah’ village in ‘Dasht-i-Archi’ district in ‘Kunduz’ province were raided by brutal invading soldiers supported by their internal stooge forces, in which, people’s houses were thoroughly searched out, then, they were badly beaten and seven innocent civilians were taken away as prisoners.

On Friday 19th August, several innocent civilians were killed and wounded in the indiscriminate bombing of puppet regime’s forces near the center of ‘Hisarak’ district in ‘Nangarhar’ province.

On Friday 19th August, two ordinary countrymen were martyred and a woman was injured in the brutal bombing and artillery shelling of mercenary forces of stooge admin in ‘Sajani’ and ‘Qarya Yateem’ areas of ‘Chahar Dara’ district in ‘Kunduz’ province.

On Saturday 20th August, an innocent man and a woman were martyred and a child was wounded in the heavy weapon shelling of amateurish local soldiers in ‘Kharoti’ village near the capital city of ‘Maidan Wardak’ province.

On Saturday 20th August, an engineer was martyred and another one was wounded in a blind attack of local in-security forces while their team was repairing some electric polls near ‘Sisi’ village of ‘Said Abad’ district in ‘Maidan Wardak’ province.

On Saturday 20th August, civilian houses in ‘Chashma Talkh’ area of ‘Ishkamish’ district in ‘Takhaar’ province came under indiscriminate mortar shelling of internal mercenary soldiers, in which, a woman and two children were wounded.

On Monday 22nd August, two villagers, named ‘Mohammad Ayaz Aka’ and his son, were martyred in the random mortar shelling of local amateurish soldiers in ‘Piro’ village of ‘Qara Bagh’ district in ‘Ghazni’ province.

On Monday 22nd August, three ordinary civilians including local Mulla Imam (the one who leads congregational prayers) were incarcerated during a raid of brutal foreign invaders in ‘Wazir Manda’ area of ‘Grishk’ district in ‘Helmand’ province.

On Monday 29th August, civilian houses in ‘Loi-Kanam’ area, near the center of ‘Kunduz’ province, were raided by savage foreign invaders supported by their internal mercenary forces. In this raid, main gates of several houses were blasted; people were badly beaten up; their valuables were looted, and eventually, thirteen ordinary villagers including local Mulla Imam were taken away as prisoners.

On Wednesday 31st August, four ordinary countrymen were martyred in the indiscriminate artillery shelling of local in-security forces in ‘Malarghi’ area in the suburbs of central city of ‘Kunduz’ province. After the incident, local people demonstrated against the puppet regime and demanded the trial and punishment of the perpetrators.
