Concerns raised over minor girl allegedly being held (Image via NDTV)

On 14 April 2016, the mother of the 16 year old minor girl, who has alleged sexual assault by the armed forces personnel of 21 RR, approached JKCCS for urgent and immediate legal assistance. Both the minor girl and aunt, and her father are under police custody since 12 April and 14 April respectively. The mother seeks that both be immediately released and allowed to return to their residence. The mother of the minor girl fears that her family members, particularly her 16 year old daughter, are under pressure to make false statements. Already a video has been released and circulated by the army that reveals her identity and seeks to exonerate the army of sexual assault. The mother of minor girl seeks that investigations in this case be done as per the law with full care and consideration being provided to the fact that the complainant is a minor girl.

The legal team of JKCCS led by Adv. Parvez Imroz reached the outskirts of Handwara town by around 10:30 am this morning. The team sought to meet the mother of the minor girl and following consultations approach the High Court, Srinagar bench, by the close of the day. Besides consultations on the case, relevant signatures on court documents needed to be taken.

A police team headed by SHO, Kralgund refused to allow the team beyond Ganapora village. State authorities when contacted by telephone refused to facilitate in the instant case and/or asked the team to contact other authorities. DIG, North Kashmir Range, Uttam Chand, while confirming that the girl, her father and aunt are in the protective custody of the police, stated that no exception could be made and access to the house of the girl for meeting her mother cannot be provided. JKCCS submitted that in special circumstances the Government does give curfew passes to the people and therefore it must be given atleast to the mother of the victim to travel to legal team waiting at the outskirts of Handwara. He asked us to contact his seniors and also that he will talk to the concerned. JKCCS then contacted IGP Kashmir, Javed Mujtaba Geelani who asked the team to contact the Deputy Commissioner, Kupwara for permission and stated that the police had no power to allow access. After this, JKCCS contacted Abdul Haq Khan, the Minister of Law in Jammu and Kashmir and also at present the incharge minister deputed by the government in Kupwara district to deal with the present situation. Abdul Haq Khan expressed his inability to interfere in the law and order tasks of the Police and civil administration. JKCCS representative told him that does the government not consider providing access to justice to the family of the victim as a priority on which he informed the team that the priority of the government at this stage is restoration of the law. Meanwhile, Deputy Commissioner, Kupwara chose not to receive the numerous phone calls made.

Section 144 Cr.P.C. is not intended to prevent civilians from exercising their legal rights particularly when violations of fundamental rights [for example the illegal detention of the minor girl and her father] are involved. A meeting between the mother of the minor girl and her lawyers could have been facilitated by the government without any adverse consequences. The government has, once again, prioritized their need for control on the people over fundamental and human rights. The refusal to allow the JKCCS team to visit the family of the victim is aimed at prolonging the illegal detention of the girl, her father and her aunt.

The Jammu and Kashmir government through its conduct in Handwara killings and sexual violence allegation has already exposed itself and reaffirmed its priority of control over civil liberties and law. It is clear that a change in government does not change the state of affairs on ground in Jammu and Kashmir.

Distinguished (brothers)! That we waged our obligation of sacred Jihad under the leadership of Islamic Emirate from before however unfortunately (in our view) due to some issues and challenges obstructing consolidation of unity, establishment and development of the Islamic Emirate as well as misunderstanding, mistrust and distance with the brothers led us to join Daesh or otherwise known as the Islamic State.

But due to the ambiguous blind policies of Daesh, their wanton killing, beating, persecution, looting, burning, and usurping land and property of the oppressed Afghans, their displacement, treachery with their elders, depriving them of schools, clinics, public welfare projects and development, heedless towards general Muslim interests, adoption of extremism over leniency, prohibiting vice in fashion which produces corruption, Takfiri (excommunication) views of most members, improper establishment of religion, and having no reasonable, legal and regular way of fixing these problems; in short not having a remedy for the wounds of the Afghans. So due to the efforts of some sincere brothers from the Islamic Emirate as well as positive, fruitful interaction and understanding nature and agreement with the Islamic Emirate, our mind and conscious could not longer permit us to stay with the said group (Daesh). Therefore in the radiant light of Muhammadi Shariah we – as the representatives of all of our Mujahideen – break our oath with the leader of Daesh or Islamic State and for the continuation of sacred duty of jihad in our motherland and for the establishment of a true Islamic government, we whole heartedly pledge our allegiance to the new Amir of Islamic Emirate, the esteemed Amir ul Mumineen Mullah Akhtar Muhammad Mansoor (may Allah safeguard him) and promise our comprehensive cooperation, untiring efforts and respects to him.

A critical component of any political ruling system is the way in which it has come to power and how it has gained legitimacy. In Islam the three ways defined for coming to power are either through force, succession or Shurah (council). However – in the west and other countries which toe the line of democracy – the only way to gain approval stamp or legitimacy certificate is through the electoral system.

The west headed by America entered Afghanistan under the slogan ‘rule of the people’ and stated that every government from today shall only come to power through the ballot box. However, in practice, it inaugurated a mechanism where the only way a person could rule over Kabul was with the blessing of America.

America initially launched concentrated propaganda depicting the Loya Jirga or Grand Assembly as the only true source that could appoint a head of state, approve the constitution and give rulings on other major matters and in this series many supposed Grand Assemblies were convened. Karzai’s transitional period, constitution, security agreement with the US, peace council and other critical affairs of the fiercely independent Afghan nation were legitimized by these so-called Grand Assemblies – the members of whom were fattened by American dollars while residing in Germany and other western capitals.

Although the Afghan nation considered such manipulation of the name of Loya Jirga as adding insult to injury but a nation whose hands were tied with titanium chains could do nothing but endure patiently.

As this game was being played with the name of Loya Jirga, the electoral drama between Ashraf Ghani and Abdullah began encapsulating the nation. The open fraud, rigging and overall chaos in the previous year’s elections failed to bestow even a semblance of legitimacy to the upcoming government. As the prescription drug of elections failed twice, the people began awaiting the convening of another supposed Grand Assembly – but to their surprise and the surprise of many others – America instead opted to deploy a Grand Wizardd.

The Grand Wizard John Kerry arrived to Kabul and with a swipe of his wand both arch rivals Abdullah and Ghani were spell bound and like remote controlled toys they began embracing each other and the result was an illegitimate offspring named the ‘National Unity Government’.

Up until yesterday everybody was told that the National Unity Government’s period was for two years which was set to expire after four months. This was not only being repeated frequently by members and media affiliated with Shura-e-Nazar (Supervisory Council created by Ahmad Shah Massoud) but meetings had also begun taking place among Team Abdullah and the opposition in preparation for the upcoming Loya Jirga or possible early elections.

The guest house of Sayyaf in Paghman witnessed many gatherings by Hamid Karzai and the opposition over the past few days. Winds of change were also being pushed by Tolo, Metra and Khurshid TVs affiliated with Shura-e-Nazar and Amrullah Saleh even went as far as to say that the term of NUG (National Unity Government) ends on 21/09/16 and any extension has to have the consent of the people.

These poor people who shouted ‘Government Government’ from the top of their lungs were unaware that the string of this kite – the supposed Government – is actually in the hands of a Grand Wizard residing on the other side of the globe.

As the believers in governmental system were sound asleep dreaming about the upcoming Grand Assembly, the Grand Wizard swooped in unexpectedly on Khwaja Rawash Airport, went straight to Arg (Presidential Palace), met with A and B and immediately convened a conference which quashed any dreams of upcoming Loya Jirga or early elections.

John Kerry extended the expiration date of the regime by three more years during his short conference and declared that the government shall complete its 5 year period under the leadership of Ashraf Ghani.

John Kerry declared “Let me make this very, very clear because I brokered the agreement: there is no end to this agreement at the end of two years, or in six months from now. This is an agreement for a unity government, the duration of which is five years”.

This announcement by John Kerry froze all debates over the government and silenced all opponents. So Bravo to John Kerry who played the role of the Grand Assembly all by himself, making it very clear to everyone the limits of control exerted over our country by the invaders. A country whose most critical decisions, even the setting up of a government are in reality dictated by the US Secretary of State.

In his recent visit to Kabul the American secretary of state John Kerry once again announced the extension of the corrupt decaying regime formed by his hands which is on the verge of collapse and is deeply despised by the Afghan masses.

Nearly one and a half year ago the heterogeneous setup of ‘Ghani and Abdullah’ was formed by John Kerry to achieve and preserve the malicious vested American and western interests. And now instead of acknowledging the inefficiencies and failures of this corrupt regime, he came here to deceive our innocent people once again by announcing barefacedly the perpetuation of this crumbling corrupt regime for three more years and instigating its incongruous policies and strategies.

We ask the stooge officials including its head John Kerry, if they can show any significant progress or development achieved by them in the past one and a half year which has resulted in peace and prosperity for the Afghans!!
The stooge admin has not succeeded in restoring peace even in the capital city of Kabul. No tangible improvements has been recorded in public health sector, mafia circles and notorious warlords are dominant in Kabul and all other major cities, unemployment has sky rocketed resulting in millions skilled and unskilled youth – along with their families – compelled to leave the country.

On the other hand, it is a veritable fact that during last one and a half year, Mujahidin of the Islamic Emirate achieved significant progress against the mercenary security forces of the stooge regime by liberating tens of districts and conquering several military bases in various parts of the country.

Internally, Mujahidin’s influence and popularity is increasing by the day. The masses are disappointed and fed up with the corrupt stooge officials of the Kabul regime and therefore refer their lawsuits and other disputes to the judicial courts of Mujahidin as they feel confident of getting free fair trials.

Similarly, despite all the malicious plans and conspiracies of colonial powers, by the grace of Almighty Allah, Mujahidin of the Islamic Emirate are still completely united, organized and disciplined under a single leadership.

The pious and vigilant people of Afghanistan realize that the ridiculous form of so-called ‘national unity government’ has no justification, neither among the masses, nor in any legal or cultural lexicon. It is said that a similar strategy was undertaken by American forces in South Korea which was doomed even before its initiation.

We are confident that by the grace and benevolence of Almighty Allah, this malicious and detested stooge setup will be shattered in the wake of fresh Jihadi operations, concomitantly launched with the New Year in our country. And the time is not far off when our pious people will be emancipated from the brutality and viciousness of this stooge regime formed by John Kerry for the protection and sustenance of vested interests of foreign invaders!

Some media outlets claimed that member of the Leadership Council of Islamic Emirate of Afghanistan, the respected Hafiz Mullah Abdul Qayyum Zakir has proposed holding negotiations with America and the Kabul administration.

Today respected Zakir Sahib while talking to Al Emarah website rejected these reports and added: “I have never proposed holding negotiations and neither do I believe in these deceiving negotiation processes”.

He further said: “We are all struggling for the establishment of a pure Islamic government”.

The respected Zakir Sahib called on all media outlets to refrain from publishing such baseless unfounded reports.

We live on the planet Earth which belongs to Almighty Allah and benefit from His enormous blessings. Earth and sky, clouds and winds, rains and snow, oceans and rivers, mountains and landscapes, crops and gardens etc ………… all have been subjected by the Almighty Allah for the wellbeing of mankind. He, the Almighty entrusted man to be God’s deputy on earth and has provided all essential items which human needs in this material life.

{وَلَقَدْ مَكَّنَّاكُمْ فِي ٱلأرْضِ وَجَعَلْنَا لَكُمْ فِيهَا مَعَايِشَ قَلِيلاً مَّا تَشْكُرُونَ} (الأعراف -۱۰).

We have established you on earth and provided you with a livelihood: yet you are seldom thankful. (Verse:10, Chapter:7)

The creation of mankind, the universe and other blessings are not vainness or mere a play.

{وَمَا خَلَقْنَا السَّمَاءَ وَالْأَرْضَ وَمَا بَيْنَهُمَا لَاعِبِينَ} (الأنبیاء- ۱۶)

Not for (idle) sport did We create the heavens and the earth and all that lies between them. (Verse: 16: Chapter:21)

There is a great aim behind their creation. That aim includes submission to Almighty Allah, implementation of Divine system on earth and leading life in the light of Islamic Shariah. When human beings lead their life in the framework of Divine Shariah then by the orders of Almighty Allah, the entire universe performs its duties normally, being at the service of mankind. But when people fail to perform their religious and moral duties and become unthankful and resort to transgressions, then with the permission of Almighty Allah changes take place in nature and blessings turn into disasters.

{وَلَوْ أَنَّ أَهْلَ الْقُرَى آمَنُوا وَاتَّقَوْا لَفَتَحْنَا عَلَيْهِمْ بَرَكَاتٍ مِنْ السَّمَاءِ وَالأَرْضِ وَلَكِنْ كَذَّبُوا فَأَخَذْنَاهُمْ بِمَا كَانُوا يَكْسِبُونَ} (الأعراف- ۹۶).

Had the people of those towns believed and kept from evil, We would have opened upon them the blessings of heaven and earth. But they denied and We punished them for their misdeeds. (Verse:96, Chapter:7)

A number of devastating incidents have been taken place during past fifteen days in our beloved country. Unfortunately, neither side has paid attention to these incidents nor anyone has extended assistance to the effected families.

1. On Tuesday, 22^nd March 2016, three people were killed and eight other injured as a result of avalanches in the highway of Raghistan and Kob Aab districts. Meanwhile, there is still risk of incidents of other avalanches in the area. According to the reports, the roads connecting the center of Badakhshan province with its five districts are closed for traffic because of snowfall.
2. On Saturday, 26th March 2016, four people of a family including a man, women and two children were martyred as a result of a land slide in Chapa Dara district of Kunar province. Reports say that due to heavy rains in the area, a huge rock slipped from the top of the mountain and smashed into a house.
3. On Saturday, 2nd April 2016, three people were martyred because of heavy rains in Gayzab district of Orozgan province while huge agricultural lands were inundated.
4. Similarly, recent rains and floods have also caused huge life and material losses in different parts of the beloved country. Thirty people have been martyred in total while thousands of acre of land submerged. Huge damage is reported from Orozgan, Daikundi and Ghazni provinces. Similarly, rains have also caused huge damages in Kunar and Nuristan provinces.
5. On Monday, 4th April 2016, it was reported that huge rocks slipped from a mountain in the area of Dap Baroro of Asmar district and the road is completely block for all kinds of traffic from past five days. Due to the blockage, people of Nari and Ghaziabad district of Kunar province and Kamdesh and Bargematal district of Nuristan province are suffering. Even, the prices of food items have soared.

Some people link bloody natural incidents with atmosphere and environmental situations. Furthermore, they try to find physical evidences and philosophies behind earthquakes, floods, storms and other natural disasters. But, in fact, actions of human being are behind these incidents. Furthermore, these kinds of incidents also demonstrate Allah’s favors to train their servants. Muslim should take lessons from these incidents, should pay attention to their deeds, repent and ask Almighty Allah for forgiveness. They should help the people effected by disasters and should work for the reformation of their society. Similarly, they should discourage immoralities and evils so that they would save their own souls and the souls of others from the torment of this world and the Hereafter and prevent would-be disasters.

The British government is directly involved in the covert US programme in Yemen, including secret drone strikes, it’s emerged, despite having denied such involvement for several years.

An investigation by Vice News, published today, has revealed that UK personnel have played a “crucial and sustained role” in the programme, with UK officials taking part in so-called “hits”, “triangulat[ing]” intelligence for target lists, preparing “target packages”, and participating a “joint operations room” with US and Yemeni forces in support of strikes.

A former senior CIA official called the UK’s role “pretty critical”, while the former Foreign Minister of Yemen said the US and the UK had a “blank check” to carry out the operations.

The reports appear to contradict years of denials by the UK about involvement in US operations in Yemen. In 2014, the Ministry of Defence told human rights organization Reprieve – which assists the civilian victims of drone strikes – that: “The UK does not provide any military support to the US campaign of Remotely Piloted Aircraft System (RPAS) strikes on Yemen”, and that “use of RPAS strikes for counter-terrorist purposes is a matter for the states involved.” The government denied knowledge of an ‘operations room’ involved in the identification of targets. Ministers also told MPs, in 2014, that there were only two UK military personnel present in Yemen.

According to today’s reports, British military personnel have been seconded to UK intelligence agencies to carry activities in Yemen under the aegis of the Foreign Office. The arrangement appears to mirror that of the US, where US Air Force pilots are seconded to the CIA for drone strikes, which are carried out in secret. A British official confirmed to Vice News that these seconded personnel were involved in the drone programme, saying: “Once they are seconded, the MoD loses any control over what they get up to.”

The UK activities are understood to have continued despite reports of large numbers of civilian casualties from US drone strikes in Yemen. Among the Yemeni civilians killed in strikes carried out with UK involvement was Nasser Salim, a 19 year old student who was hit in May 2012. Nasser – whose family are assisted by Reprieve – was killed in what was the fourth US attempt to kill a militant, Fahd al Quso. A recent investigation by Reprieve found that such ‘multiple kills’ of named targets are common in the US drone programme, with some 1,147 unknown people killed in attempts to target 41 named individuals.

News of the UK’s role comes ahead of the expected release, later this month, of the first White House estimate of the numbers of civilians killed by US drones. Asked about the issue last weekend, President Obama said that there was “no doubt” that civilians had been killed by US drones.

Commenting, Jen Gibson, staff attorney at Reprieve, said:

“For years, the government has denied any involvement in US’s covert drone war in Yemen, saying it’s ‘a matter for the states involved.’ It’s now beyond dispute the UK is one of those states – working hand in glove with the Americans to create the very ‘kill list’ that drives those strikes. Even more disturbing, the UK has copied wholesale the US model of outsourcing the military to the intelligence agencies in order to hide their involvement and avoid any accountability.

“Nasser Salim’s family, and the hundreds of other innocent civilians killed by this failed programme, deserve answers. There needs to be an urgent inquiry into just how far the UK’s involvement in this covert drone programme goes – both in Yemen and beyond.”
